These Terms and Conditions ("Terms") define the relation of villasinbali.com ("the Company," "we," "us," or "our") to individuals reserving villa accommodations through our website ("Guest," "you," or "your"). You accept these Terms with by reserving a villa through villasinbali.com.

I. Definitions

  • Company: refers to villasinbali.com.
  • Guest(s): refers to the person(s) making the booking and all individuals occupying the Property during the Rental Period.
  • Property: refers to the specific villa, including its grounds, pool, and facilities, booked by the Guest through the Company.
  • Owner: refers to the legal owner of the Property.
  • Booking: refers to a confirmed reservation of a Property for a specified Rental Period.
  • Rental Period: refers to the dates from check-in to check-out specified in the Booking confirmation.
  • Security Deposit: An amount held by the Owner or Company to cover potential damages or breaches of these Terms.
  • Force Majeure: Any event beyond the reasonable control of the Company or Owner, including but not limited to acts of God, natural disasters, war, civil unrest, terrorist activity, epidemics, industrial disputes, or adverse weather conditions.

II. Booking and Payment

Booking Confirmation: A Booking is confirmed only upon receipt of the required deposit payment and issuance of a written confirmation by the Company.

Deposit Payment: A non-refundable deposit (generally 25-50%) of the total rental amount is required within a certain number of calendar days (eg, five days) from the date of booking confirmation. The percentage and due date will be specified during the booking process. If the deposit is not paid within the due date, the Booking will be canceled automatically without further notice.

Balance Payment: The due date for payment of the balance of the total rental amount is specified for a period prior to arrival (for example, 45-60 days before arrival). For reservations made fewer than the specified balance due period prior to arrival, the entire rental amount is considered due immediately upon booking confirmation. Should the balance not be paid on time, the Booking may be canceled and the deposit forfeited.

Payment Methods: Those payment methods will be stated at booking (for example, bank transfer, credit card). Guest will be responsible for any costs associated with the bank transfer fees or credit card surcharges.

Pricing Prices: All prices are as stipulated on the website or as quoted at the time of booking. Pricing subject to changes depending on current market conditions when new bookings are made; however, once the booking is confirmed, the price becomes fixed.

Such additional charges may vary but would typically include accommodation, linen, towels, basic cleaning, and the use of utility charges (electricity, water). Certain extra services, such as through extra cleaning, chef services, babysitting, food, and beverage surcharges, will incur additional charges and will be communicated to the Guest.

III. Cancellation and Amendments

Cancellation by Guest

  • Cancellation must always be made in writing (via email).
  • Guests will lose their non-refundable deposit for the cancellation of a confirmed Booking.
  • Cancellations made after the balance payment due date will generally be totally non-refundable. It is strongly advised that Guests acquire travel insurance for this purpose of minimizing these losses.
  • No refunds are available for early departures or late arrivals.

Cancellation by Company/Owner

  • In the unlikely event that, due to Force Majeure, damage or unforeseen circumstances beyond our control, the Company or Owner cannot secure the booked Property, the Company will do its best to offer:
  • An alternative Property of comparable standard, where available. In the absence of a viable alternative, a full refund of all amounts paid by the Guest for the Booking will be made. The Company shall not be liable to pay any further compensation or expenses to the Guest.

Amendments by Guest

Any Booking changes requested must be put in writing and will be subject to availability and Owner approval may incur an administration or rescheduling fee as well as any difference in rental price. Downsizing guests or rental length after confirmation does not incur any refund or discount from the total amount of rent.

Amendments by Company/Owner

The Company or Owner reserves the rights to make minute modifications in the Booking details. You will be notified of any major changes and you will be offered the chance to cancel and get a full refund if those changes are not minor.

IV. Guest Responsibilities and Obligations

Maximum Occupancy

The number of guests occupying the Property must not exceed the maximum occupancy stated in the Booking confirmation. Any additional occupants without prior written approval may incur extra charges, or the offending parties may be asked to vacate the Property without refund.

Check-in/Check-out

  • Standard Check-in time: After 4:00 PM local time.
  • Standard Check-out time: By 10:00 AM local time.
  • Specific times will be provided in your booking confirmation. Requests for early check-in or late check-out must be made in advance and are subject to an additional fee. Unathorised early arrival or late departure will incur a charge of one half or full night of additional rent.

Security Deposit

A security deposit will be authorized against your credit card or collected via bank transfer, as applicable, before your arrival. This deposit secures the Owner against any damage to the Property or contents therein, excessive cleaning, or any charges left unpaid. The security deposit will be released or refunded by the Owner within a certain specified time after the check-out date, from 48 hours up till 14 days, assuming no damages or breaches of these Terms have occurred beyond normal wear and tear.

Property Usage

The Property shall be used as a private vacation dwelling only. You agree not to use the Property for any improper, illegal, or commercial purposes, including but not limited to house parties, events, or gatherings without prior written approval thereof from the Company or Owner.

Cleanliness and Maintenance

Guests are responsible for the upkeep of the cleanliness of the Property. This includes washing dishes, taking out all rubbish, clearing out the refrigerator, and setting back furniture into its original placement. If, in the Company's judgment, the Property leaves requiring excessive cleaning, and extra charges might be incurred. Guests are also responsible for any necessary reporting of damages to or disrepair of the Property during the stay.

Noise

Guests shall respect the privacy and peace of neighbors. Any excess noise, particularly noise emanating during the specified quiet hour (for example, from 10 PM to 9 AM), is not acceptable.

No Smoking

The entire inside area of the Property is a no-smoking zone. Valid smoking zones will be specified, and invalid ashtrays must be used outside. Damage from smoke cleaning will be charged to the Guest.

No Pets

Under normal circumstances, pets are not allowed unless expressly permitted beforehand by the Company or Owner in writing and may incur extra fees.

Guests are responsible for the security of their items and properties, including valuables. It is advisable to secure valuables in provided safes and ensure the Property is locked when not in occupation. The Company and Owner shall not be liable for theft, loss, or damage to Guests' belongings.

Behavior

The behavior of the Guests and all members of their party is their responsibility. In the case of reasonable evidence of any behavior complained of, the Owner or his representative, in full discretion, reserves the right to remove the offending party from the Property without refund.

Compliance with Law

Guests must comply with all laws and ordinances applicable in Bali, Indonesia, for the duration of their stay. Illegal favors, such as the consumption or use of illegal substances, shall not be tolerated and will expose the Guest to immediate expulsion from the rental agreement, as well as police involvement.

V. Company/Owner Rights and Responsibilities

  • Right of Entry: The Owner or their representative has the right to enter the Property at reasonable times for maintenance and repairs as well as for showing the Property to prospective renters, given reasonable prior notice (i.e., 24 hours) unless in case of emergency.
  • Inspection of Property: The Company or Owner shall have the right to have the Property inspected at any time during your stay to verify compliance with these Terms.
  • Services Provided: The Company shall ensure that the Property is made available as is described in the Booking confirmation and on our website.
  • Limitations on Liability: The Company or Owner shall not be liable for any injury, death, loss, convenience, or damage, changing, delay, or cancellation of the Booking due to Force Majeure or any causes beyond the control of the Company or Owner. The above includes but is not limited to interruptions in local utilities (like water and power supply).
  • Third Party Services: The Company may help in procuring third-party services such as transport or tours, but these services tend to be provided by independent contractors, and therefore the Company cannot be held liable for their acts, errors, or omissions, nor any damages flowing from such services.

VI. Insurance

All Guests are strongly advised to purchase comprehensive travel insurance covering unforeseen circumstances, including but not limited to:

  • Trip cancellation/interruption.
  • Loss or damage to baggage and personal property.
  • Medical emergencies and evacuation.
  • Personal liability.

VII. Miscellaneous

  • Governing Law and Jurisdiction: These Terms shall be governed by and construed according to the laws of Indonesia. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bali, Indonesia.
  • Severability: If any provision of this Agreement is deemed illegal, invalid, or unenforceable, it shall remain so to the maximum possible extent; however, all remaining provisions of this Agreement shall remain legal, valid, and enforceable.
  • The entire Agreement: These Terms constitute the entire agreement between the Guest and the Company regarding the Booking and supersede all prior agreements or understandings, whether written or oral.
  • Headings: The headings in these Terms are solely for the purpose of convenience and do not affect the interpretation.
